Would you make someone pay for smashing your windshield with his body?

You're driving along at the speed limit, suddenly some idiot pops out from behind a parked truck talking on his phone, smashes your windshield with his body then gets up and limps away, would you run after him to get his information, or call the cops? Assuming no insurance coverage, would you make him pay for a new windshield?

    Speed limit or not, if you hit a pedestrian, it's usually your fault, at least in the court's eye. Simply going the speed limit doesn't mean the driver was also sober, or paying attention, or not on his own phone. Regardless of pedestrian error, 9/10 times the driver does indeed have plenty of time to stop if they're driving well.

      I'm not disagreeing but I remember an incident when I was a boy where a man was leaving work in the wee hours and hit a drunken man who walked out in front of him. It was dark of course and a black man dressed in dark clothes walked out in front of him beneath an overpass. The driver told my dad that he wasnt speeding but by the time he realised the man was there it was too late. He was very shaken up and the poor man he hit died on the spot.

    You realize in this hypothetical scenario that you have just hit a pedestrian. In some jurisdictions the driver is almost always at fault.

    You should probably just call 911.

    Those are the times when you need a dash can in your vehicle to show just what happened. And I disagree, if someone pops out from between vehicles, in his phone not looking for traffic, it's that idiots fault. Especially if he didn't cross the street at an intersection using the cross walk and the pedestrian signals. And yea, I would have chased him down.
