What should i do with recorded phone call that went bad

So I have a recorded phone call of the franchise operator stating openly that nothing will be done about a manager being childish about getting me my w2.

Legally, nothing may have been done wrong but I'm so not okay with how it was handled and I want to throw a wrench in their machine.

Is there anything I can do? I also have a recording of the manager acting childish, but not the exact incident

Also, I guess, is it normal revenge? Some of the negativity I'm getting comes from a place of discrimination I think, so I'm responding in kind with a contempt for mental deficits

Federal law requires all employers to send employees W-2 statements no matter how low earnings or wages are. These W-2 statements can be sent in either paper or digital form and must be received by employees no later than January 31 of the following year. Employers must also file a copy of employee W-2s with the IRS. Assuming this was an incident from last year (as in, the January 31 deadline has already passed) you can call up the IRS and tell them about this business's failure to comply with the law.

    • They're giving me the w2, but instead of being able to get it from the office I have to mail them a stamped envelope so they don't have to pay for postage.

My issue is the childish disrespect from everyone involved. This is supposed to be a business right? I want accountability for their actions.

Then, they are indeed refusing to send it to you. It is far past the deadline at this point, so you can go to the IRS to solve your problem. If the company won't give it to you, the reason for them not giving it to you doesn't matter; it's still illegal.

        • I've already sent the letter, but uh, I do have the recording of her assistant at first saying they'll send it but the franchise owner requesting I send postage. Soooo, I can send the irs that phone recording and she's liable? I live in North Carolina

North Carolina is a 'one-party consent' state. If you are in the recording yourself, you obviously consent and can use the recording to report them either to higher-ups or if a law has been broken you can indeed use it in a legal case. You could contact a lawyer who might answer whether you should bring it to the IRS- some law offices will answer brief legal questions without pushing for you to come into their office and hire them (if you have a case).

I don't know the answer to that question. I don't work for the IRS. The best way to figure that out is to try it.

      By calling, you consent.

    • They didn't have to be rude to begin with, I was polite. I didn't want to talk to them at all outside of getting my w2. There were so many steps taken to be rude! Just because I'm not in someone's norm.

I think you're overreacting. They're just following policies.

        • It's policy to get my name, then say that's how you spell it not how you say it, and refuse to give the office number to get someone a w2, who then has to call another McDonald's to get the number, who then deals with the same shenanigans by the franchise owner?

Who says theres even a number? And it's perfectly normal to ask how to pronounce your name.

            • I needed to call the office to get my w2. What you're replying to is what happened to me, not a general what if scenario.

And yeah sure it's normal to ask how to pronounce a name, but what's not normal is being able to identify someone but still giving issue to admitting being able to identify them. I know he knew who I was because he called me Ariel before I gave him that, he remembered me but pretended to not know me.

    Wait, you work for mcdonalds?
Unless you are 15 or own the franchise.
    Get over it, move on.
Why are you wasting your time.
    Find a better job.
Your tax return is not that great.
    If youre worried about it.
    Go ahead and file.
But by all means find a better job.

    • I have a better job now, back then I was doing McDonald's in the morning and delivering pizza at night. My car broke down after a few months and I stayed with the pizza place and became a manager and work great hours and work with great people. I'm grateful for my job here, I've done so much with it.

I just hate that they think they can do whatever they want to whoever they want. I know the unbiased viewpoint would be to let it go, but my perspective is more developed to what's going on.

Why don't you just write a letter of complaint instead? A bit old-fashioned and a little less sexy, I know, but that might also contribute to change, and with a little less carnage along the way...

Letters of complaint end up in a digital ticket anyway, and treated as normally by customer service.

Did you record your manager without him knowing?

A lot of companies have the policy to disconnect the call once they are made aware of the recording.

    • I'm in a state that only needs one party on the phone to consent to recording

She should have suspected it though, since I was very clear I had recordings of the foolishness of this manager, which she did not want to hear

It just seems underhanded and a bit twisted to me.

Imagine if we lived in a world where we were worried that people be secretly filming us all the time. If enough people did what you did then that world would become a reality.

        • It's underhanded to outsmart someone trying to be rude to me because of my life choices? I call that poetic justice.

I think it's dirty to treat someone poorly like they're treating me. There's a fine line between allowing karma to take place and taking it into my own hands, and I understand what that difference means, but I feel justified in taking *some* action.

Alternatively, I am thinking about sending them a glitter bomb. Might just be easier.

"I think it's dirty to treat someone poorly like they're treating me." I completely agree with you. I think that, from what you've posted, they have done you an injustice that should be rectified. I just disagree with your tactics in accomplishing justice in this case.

I do hope you get your way with this tho, OP, they should be acting responsibly in this situation, and not in a disrespectful manner.

            • How should I handle it? IRS seems like a good option because it seems like I just need to point them in her direction.

Glitter bomb seems good because I just need to buy one, if I can, and them opening it will cause a massive clean up bill.

              But what's the better option?

What did they say in the recording? Unless it's something they did wrong it may make you look worse than them for releasing it.

    • If you like psychology or reading people or anything like that, you can see a lot of what I'm talking about in how she talks and responds, some moments show the facade slipping. I try to keep my cool the whole time.

      Comment Hidden ( show )
    • Well she first said they only need my legal name for legal things but can call me whatever, then boldly uses my legal name and gives a totally insincere remark.

Really the recording just shows how much she doesn't care what happened, how and why she thinks I'm worthless, and how she's literally only doing what she needs to do.

There is one part where she's like " I know the law better than you" when I said they have to give me the w2

I could share the recording, if someone thinks they can help market it

According to this, the most she could get for my incident is like a 200 dollar fine. I can let them assess her risk level and leave it to fate if she's investigated, I'm willing to play the odds.

But for my own sense of acknowledgement, I'll mail her a glitter bomb. There are a ton of sites, all fairly cheap and creative ways to do it; I just wish I could use the one in that popular video.
