Should i verbally comply with cps when im not legally bound to?

A month or so ago I got a charge which triggered a CPS referral into my life. This charge has since then been dropped. Dismissed, nonexistant. I am not legally under a court case with CPS. However, my "Case worker" insists I verbally comply with everything she says or she will open a courtcase. This includes letting my daughter stay with someone else. It has been over a month and they still want my daughter there under something called a "Safety Plan" away from home because of the nonexistant charge and until my completion of a checklist of things they wanted for me to do. This included getting all of my gov. assistance and to attend a particular therapy due to my nonexistant charge. I had just moved to this state and was already in the long unfortunatley for me drawn out process of getting assistance due to Ohios system anyway so ok I can do that I thought. Keep in mind, eventhough there is no longer a charge, Im having to wait until my assistance is fully active to even have my baby home. Now that I have gotten it taken care of, have assistance, medicaid, am working, in college full time online, my solo rented 1 bed apt fully equipped for my daughter,(she has her own room) and I am attending therapy my CPS worker decided to randomly drug test me, but I am dirty for marijuana. It will detect the past 30 days yes im guilty. However, I hardly smoke. I was honest and told her I want to wait until the marijuana is out of my system. She said if I dont take it she will open a court case. Now I have a dirty urine test showing results pending in a week so they are going to open a court case. Also, they are going to want me to verbally agree not to have my daughter over for Christmas until then. No unsupervised visits with a dirty test. I got one for Thanksgiving, listened to everything they want, but now what. I feel like I already had a court case open anyway. I vow to quit smoking. I will be clean from now on. But I just feel attacked, and I miss my baby girl. Shes taking it hard. Which is killing me. Legally I could go get her now. But once again, Court Case!! Wouldnt be any new charges ,just a court case, which is whats happening anyway!! Thoughts???

    Clean up your act and comply with whatever they ask of you, if it's so important to have your kid back. After things have stabilized, and you have your kid, move to a state where marijuana use is legal. Meanwhile, I've heard there are resources on line that can minimize the trace evidence in your system. If it's been a while maybe you'll be "clean enough" if you try some things. Good luck!
    Smoking marijuana doesn't make you a bad parent, but if you would choose that over your child then you're an irresponsible parent.

    Don't comply with CPS it sounds like they made a mistake and have nothing else better to do then tell you what to do but your the fool for doing what they say.

    Like they say, if you can't do the time, don't do the crime. You must have had an attorney for the original charge. You should have had them fight the CPS one. But now that you complied with CPS, you are screwed. You probably knew about the drug tests before you started this whole procedure. You should have just quit doing dope way back then and all would be OK now. You can still try and fight it with a lawyer, but just because the first charge instigated the CPS part, does not mean that they are legally connected. Once CPS was aware of what they perceived as a problem, they can proceed on their own and not be legally connected to the other.

    Go and talk to a lawyer. There must be lawyers in your area who would give you advice free of charge as a public service. Go online and check it out. I am assuming you are short of money.

    Your drug use is hardly a hanging offence but you would be wise to stay clean. You are likely to damage your case if you keep using. Seek medical help if necessary.
