Pistorius case - murder?

In the Oscar Pistorius case, if you have been following it, the facts as presented by the defence are essentially this:

- Pistorius woke up in the early morning hours;
- he heard a noise coming from the bathroom;
- he retrieved his 9mm pistol from under his bed;
- went to the bathroom, where the toilet door was locked, and shot into the toilet 4 times;
- he went back to his bedroom and noticed that Steenkamp was not in bed;
- he realized that he had probably heard and shot her, and returned to the bathroom;
- he beat the door down with a cricket bat;
- he found Steenkamp shot to death;
- he dragged her body downstairs, calling for help.

Now, forgetting the prosecution's presentation of the facts, it seems that it will all come down to whether the judge believes this version of what happened.

Do you believe it?

I believe he thought it was a burglar. 1
I think he didn't know, but acted reasonably. 0

    His explanation cannot be proved wrong but sounds extremely, extremely tenuous. Even if every word he says is true, it sounds to me like manslaughter at the very least. An innocent person died due to his irrational over-reaction and neglect.

    I think he got tired of hearing her complain about leaving the seat up.

    As much as you may think you have all the facts, I'm sure you don't, so you are just messing around with uninformed guessing.
    Let's wait until those with ALL the facts decide; the jury.

    • These are the facts as presented by Pistorius' defense team. I know I don't have all the facts, simply asking whether folks believe the defense presented.

      There is no jury trial in South Africa.

    There's little doubt in my mind that he knew she was in there when he fired his gun into the door. His explanation of mistaking her for a burglar is simply not believable.

    Whether or not his honest intent was to kill her that night is another issue, but in a criminal case like this it doesn't really matter.
