Is this legal or illegal?

You're sat at a restaurant with family. Some guy comes over and takes a photo of you entire family and stands up against the table to get the shot. Your family kindly asks him what he's doing, he says he wants to take a photo. Your family says please stop but he takes one more.

Then, when one of you excuse yourself to use the bathroom and notice there's a line so you wait outside, he is stood there and stands two feet away from you and snaps another photo of you. I told him to stop and he said "I'm allowed" and took another photo or two of me. I said please stop again and he just ignored me. One of the waiters saw and said you need to stop and he said "I'm allowed". Then after I exited the bathroom, he took one more photo of me.

    I don't know if it's illegal or not, but that's obvious violation of privacy to me. That guy deserved to have his ass beat for doing some invasive/obtrusive shit like that.

    Well at the least its harassment. However I think there is a rule you can take anyones public photo. However I dont know what the rule on posting those pictures is. I personally would not have cared if they took my photo. However what I do not think is legal is taking pictures outside bathroom. I not sure what charge that is though.

    I think in the restaurant, once you told him to stop, he was in violation and should have been booted by the restaurant. Outside is a stickier situation in that it is a public place. That being said, if you pound the shit out of him and take his camera, you will end up being either arrested or sued by an ambulance chaser. That's how our great country seems to reward the bad and penalize the good.

    It probably isn't illegal to take the photos, but how they are used is certainly defined by law. Also, he is NOT allowed to disrupt a place of business and the management should have booted him out, when you complained.
    Personally, I'd have taken the camera away from him and deleted the pics he took of us and given it to the store manager to hold. If the camera was cheap enough, I would have destroyed it and let him sue me to get recompense.

  • I'm not sure, but since it is a private owned business, when the waiter told him to stop, he could have been removed from the establishment.

    A public place like a park or outside on the sidewalk would be a different situation.

    Doubt it's illegal (look at celebs & paparazzi) but I think if that was my family there would be a bit of a scuffle after having to tell him to piss off 2 or 3 times.
    Maybe after the first time depending on his attitude. That's just weird...
