I was on holiday once with friends. I was sharing a room with this guy, we had a bed each. One of the nights I went out and got really drunk. I came back to my room to crash out but only to find my bed had been joined up with the other guys bed. He was lying there with this girl. I said hi to them to start with then he asks me if I wanted to have a threesome.

Being really drunk at the time I decided to go along with it so I stripped to my underwear. The girl then looks at me with a cheeky smile on her face I smiled at her back then jumped into the bed with them. I lay there for about a minute then hesitated about what I was about to proceed with, so I got up left the room for 5 or so minutes to think about it before deciding to jump back into the bed with them.

When I jumped back into the bed the girl was lying there facing the guy I thought they were kissing or something. I cuddled up next to her and then began to touch her thinking that she was liking it.I then went to place my hand down her underwear. The split second I attempted this she grabbed my hand and forcefully withdrew it. After that I thought she must not want to have a threesome so I stopped what I was doing and did not try to do anything else. She never said anything or got up and left, she was still in the bed the morning after with me and the other guy.

But a week later she went round telling everyone what I had tried to do to her. According to her they had both fell asleep by the time I came back into the room and had woken up to my hand about to go down her. If this was the case then I can swear on my mums life I was to drunk too realise this. If I did then I wouldn't of dared to do it. It was only a matter of minutes after She watched me agree to this threesome my friend had offered me and jumped into bed with them aswell.

Could I have been charged with rape had my hand went further down her underwear without her knowing?

I feel really guilty about this and have not had the chance to apoligise to her.

    You can always be charged with anything but unless you have the most incompetent lawyer on earth and a judge, jury, and prosecutor out for blood it would never stick. less than 3% of sexual assault cases receive convictions.

    There is ZERO reason for you to consider yourself a rapist.
    Putting aside the fact that you didn't even fuck her, they invited you into a threesome so she Gave her consent, and when she later resend ed her consent you stopped immediately.

    That's the main point right there, you had her permission until she said no and that's when you stopped so no you did nothing wrong and should NOT feel guilty.

    If she's telling other people this remind them she invited you into a drunken 3way and when she said no you immediately stopped,

    If you had penetrated her (with you fingers) while she was asleep that could be considered rape. But given the circumstances, I think you'd have a pretty good defense.
