Is it normal that the police officer didn't read me my miranda rights?

My dad had let me borrow his car so i could go to my friends. So on my way home i got pulled over. Not knowing i had went over the speed limit, a police police officer stopped me. He ran my license plate. I was told to get out of the car and put my hands behind my back. He cuffed me and threw me to the ground as my face hit the pavement first..he then started belittling me saying I'm a stupid good for nothing Mexican. By the way he didn't read me my Miranda rights. Not to mention he went through my phone and vehicle without having a search warrant on him... The police officer was caucasian husky looking and rather tall for my height. I'm an 18 year old hispanic male and it turned out that the police officer thought I was my dad just because we look alike. I was ticketed with a fine of $250...

What do you think about this? Is this normal? Did he belittle me just because of my race?

    This is a common misconception. Police don't have to read you your rights until you're officially in a custodial interrogation. From what you describe, you were just being detained, you weren't actually 'under arrest' or 'in custody' by legal definition. They can ask you questions at this point. You don't have to answer those questions. If you do answer those questions, it's admissible in court.

    Search warrants are granted by Judges, and require probable cause. He doesn't need a 'search warrant' if you give him permission to look. He also has the right to look if he sees anything illegal in plain view. He CAN look if he has probable cause, without your permission. You should deny him permission to look, then possibly anything he finds may not be admissible, no guarantee though, but it's best to deny regardless.

    You were ticketed for $250 for looking like your dad? I didn't realize that was a crime. No, really, what was the ticket for?

    You don't have to be read your Miranda rights when arrested. However, if you make any incriminating statements after being arrested, the prosecutor won't be able to use those comments against you in court. If the officer thought you were your dad, then your dad must be wanted for something. You were speeding. Man up, stop looking for discrimination everywhere, and stop whining about it!

    I'm not sure about the laws in ur country but in mine if the officer don't read u ur rights it's an unlawful arrest and the case will get thrown out. Also any evidence obtained illegally ( no search warrant) can't be used and must be excluded

    :/ It depends entirely on the cop and the area you live in, but I've heard far too many cases of police targeting minorities and enacting more violent measures against them than against white people.

    You'd think we overcome this shit by now, but profiling is so evident it's sickening. Even I've been prone to it... go figure, skinny little white girl gets picked up by state troopers in the middle of the sticks because *she* was the responsible one and stopped her friend from driving intoxicated... friend ran from the cops... I was the one being threatened and made fun of because of my crazy hair and piercings and style of dress.

    Don't wanna say cops suck, but assholes should avoid that profession, please.
