Is it legal for a parent to take a child's property and trash it?

My parent owns a business and allows me to work there for around six to seven hours on Saturdays then he pays me out of pocket twenty dollars each time I work. I usually have that plus tips from customers. I then used that money that I worked for to buy a object.... Cards against Humanity. He had found the game and I'm pretty sure he is going to throw it away, It's not the first time he had thrown away stuff of mine, But this is different. I bought this with my own earned money and though I lack the receipt, I can recall of how and where I bought it and I have others who can back me up on it. I had gotten it for around twenty-five to thirty dollars at Barnes & Noble... I want to finally stand up to him for the right of something that is truly mine... So please help me.

Guess what... you can throw away a bunch of his stuff and it's not illegal either. Just empty his clothing drawer into the garbage.

Yeah, my mom used to do that bullshit to me all the time, I fucking hated it. If you're under 18, and living in their house there ain't shut that you can do unfortunately. I wish I had all the weed my mom stole from me, and threw out.

I really wanted to hate on your cards that you bought, but I just looked at them online, and they're hilarious! I wish you well.

Consider your self lucky that she took it. Weed, in my view, is bad, but it think what does the most damage is the smoking.

Stealing is stealing, but I'm sure she thought of it as confiscating contraband if I know my mother.

Taking something away for a time is one thing. Throwing it away is ENTIRELY a different thing.

It is rated as an offensive game. I would have tossed it too. If you were bringing porn into his home, I imagine that he would throw that out too. He doesn't want that trash in his house. I imagine you and he had words over him doing this and I bet that you conveniently left out that part. However, if you don't like his rules, move out, get your own home and make your own rules.

I say they still cant legally do that if he is 16. If he has proof of the receipt of purchase, he can sue his parents.

I just find it incredibly wrong to do that to someone who has worked hard for their own belongings. You have no right over other peoples stuff.

It doesn't matter what you say. The fact is it's legal. I didn't say I agree with that. I didn't say I have a right over other people's stuff either.

If you want to remain ignorant and pretend the law is based on you, not my problem.

Its not the law if the other person OWNS it. I dont think you understand the law.

Educate yourself please. I'm not doing the research for you. He bought it, yes. He owns it? Not exactly. He's not yet 18 and is dependent on his parents. His parents can take whatever game they want from him, it doesn't matter if he bought it or not. You can figure this out with a simple Google search.

OP is afraid his father will destroy the game or dispose of it: IT HASN'T EVEN HAPPENED YET!

legally , someone under 18 cannot enter into a purchasing contract. Technically legally children cant buy anything in the USA. example and this happened a child went to a car dealer and bought a new car and crashed it. because they were under 18 the dealer ate the bill. Turns out a minor cant enter into purchase contracts . that includes use of money for all debts public and private. the law just looks the other way untill its is forced to issue a ruling.

It not being legal to buy a car or enter into any form of contract under the age of 18 is NOT the same thing as saying someone under 18 can't buy anything, because obviously they do so all the time.

legally a parent can toss any thing into the garbage they dont want in the house , thats the law . you might get a advocate to defend your position in court but an appeal decision you would lose. you see your rights are not the same as renters rights. are you going to prove in court you are a renter?

This is why kids are allowed to leave home at 16. So that they dont have to deal with their parents potentially stealing their things.

Not if it was paid by working for it himself. Then no.

Says who? The child is paid under the table by the parent. It's no different than getting an allowance. As long as the parent or grandparent is the legal guardian they can do as they wish.

The OP needs to find a better place to hide their games or contraband.

But he worked for it himself, so therefore it's his.

Thats not right to have the kid work hard, and then take away the stuff they actually earned.

Why should the kid even work if his stuff is going to be taken away??!?!?

          It. Is. His. Stuff.

              I would win.

If he's 16, and worked for it himself and has the receipt.

I dont think it matters that he lives with them. At a certain age you gain independence.

Thats your property! If you worked for it, then he should legally have no say with what to do with it.

Doesnt matter that your living with them, it's still yours.

Take him to small claims court & find out.

Is it really worth causing a massive rift in the relationship between you & your father for something in the grand scheme if things is rather inconsequential?

    • He is my grandfather. I already don't like him. And I never like getting involved with court because my grandmother and others in my family scare me about it, Like one lick of me getting mixed in all that, I'm going to be taken away from the state even though I have all of the following: Food, Shelter, and clothing. I have a large room, Plenty amounts of foods and beverages, and too much clothing. They don't hurt me in any way and they don't call me names (Except from my sister, But siblings fight- So eh)
Point is, they still overly scare me about that stuff and I legally can't drive and they won't let leave the neighborhood alone.

Is there nowhere else you can move to? If not why don't you just hang tight until you can do so. Find some work and activities to keep you away from the family & earn some cash.

If you have some things you want to keep away from prying eyes why not buy a strongbox? I had one when I was younger & it drove the family mad, they were always asking me what was in there.
