It most likely reverts to 'unlawful search'...as long as you aren't acting a fool then they can't just assume you're drinking alcohol and go ahead and search your belongings, even if it's common to have alcohol in paper bags.
The local law varies...some places require alcohol to be bagged and others don't and not all ban all drinking in public and the definition of public can vary too.
It really depends who you are and where you are. From my experience, this is common among the homeless, they already have it bad enough, so who's going to stop them for public drunkeness or open container laws?
I've gotten stopped by cops for drinking nonalcoholic beverages in paper bags. Don't think you're above the law by drinking a beer in a bag.
