Can a singer get sued for this?

ok, so i have wrote a song and the costume that the japanese vocaloid hatsune miku wears would fit perfectly for it!

Its not exactly the same, it has no vocaloid symbol on, and its orange instead of the aqua/turquoise original.

However, my friend has said that the company who created hatsune miku will sue me.

I really want to wear this costume, but now im scared of getting sued.

I would be grateful if somebody could tell me if it is legally possible for me to get sued, and if there is a loophole to prevent somebody suing me.

and is it normal to be worried about this?

no you cant get sued. hatsune miku is an international public project, made by the general population. all her fame comes from people like you

Naah, (Thank Gawd I'm familiar with Vocaloid) As long as you're not making profit on it, then it should be perfectly fine!

I always thought someone could sue you for any reason they want to

    • It's probably true if you live in the States.

Ever heard of that person who sued I think it was Mc Donalds because he/she burned him/her self with a coffee? He/she won the cause because it wasn't written that the coffee was hot. It's so fucking retarded.

OP does your singer wear it all the time? Does she have it trademarked like it's hers? If not, I doubt you can get sued. Besides you said it's not exactly the same that she has.

actually, it was an 80 year old woman. she got 3rd degree burns on her bum and yum-yum. she had to get skin grafts. that's some pretty goddamn hot coffee!

        • I hope she isn't gonna drink coffee anymore.. Unless she's planning on getting more operations and winning a few millions dollars.

          I'd totally do it again.

Probably depends what country you are in. I'd look it up, but as long as you are not making money out it then I'd be very surprised if you could get sued for it.

    • what do you men "making money" do you mean wearing it on stage or selling it?

Either of those. If you are making money using somebody elses trade mark, they can sue you. If you are wearing it for fun, then they probably would not sue you. You also could not use it to advertise for a company.

In that case, you'll be okay so long as you do not use hatsune miku's name.
