So if a singer wore a costume that looked a LOT like a vocaloids costume, Could they get sued? if so how can they wear it and not get sued?

    I doubt it, but if this actually affects you (I rather hope that it doesn't), I'd look it up or find a lawyer who won't laugh at you. At a guess, I'd say that you are safe though, but it probably depends what country you are in as well.

    If the costume became part of the singer's commercial success or if you were guilty of traducing the good name of a person or institution and this was associated with the costume, maybe.

    This is a crazy litigious world. Coca Cola even copyrighted the exact colour of red used in their logo (and Father Christmas' costume). If a company can take ownership of a colour, anything is possible.
