I was in this situation recently. I told him he shouldn't do it, and he stopped for a few minutes, but then started doing it again. I told him that he can put his own life at risk if he wants to, but that I wouldn't be his passenger again if he put mine at risk. I also said that it was unfair of him to criticize other drivers (he has major road rage) and then, hypocritically, to not consider their safety himself. He was sort of pissy with me for a bit, but he got over it. I hope he's stopped texting not only with me in the car, but all together while driving, but somehow, I doubt it.
Now, if only I could get him not to text while he's having a face-to-face conversation with me . . .
