insurance salesman here... when you sue you dont sue the actual person u are usually sueing the ins company that covers them. Whether or not you think it's morally correct if you get hospital time u r going to be down a pretty penny. think of this a medivac helli charges starts at $40,000, so lets see u morally correct non sue ppl deal w/ that.
in most cases I wouldnt just bcuz im not a money hungry bitch. however, if the person was a total jerk that had plenty of money but stole from people less fortunate, or some other similar, serious character flaw, in rare instances its be possible, but unlikely overall.
I would get the police involved. Why? This person may have DUIs. Additionally, I would pursue litigation if they did have DUIs and were drunk when they hit me. I might win. I might not. But, I wouldn't feel good about not protesting this person driving around if they hit someone again and seriously injured them or killed them.
Well in order to sue someone for something like that you'd have to have suffered a loss-medical bills, lost work, a physical disfigurement and/or loss of function and so on.
I personally wouldn't run to a doctor unless I was in serious pain or needed stitches or something and even then I doubt I'd sue someone, I guess it would depend more on if I was going to lose function or have some kind of continuous problem or a horrible scar or something.
True. However, for just about any type of accident, you can claim you have back or neck pain, which is impossible to disprove.
Like I wrote in the poll question: "you were NOT seriously harmed".
Of course no one would fault you for suing if you were seriously injured, but that's not what this poll is about.
