The laws are gender-neutral here (US) so the law itself doesn't discriminate. The fact that more women than men have custody does not mean it's due to unfairness.
UK laws aren't any less neutral, as far as I'm aware.
But you can't completely remove human judgement - so however unbiased laws might be, when you factor in the human application of them, that is where discrimination can arise.
Prejudicial trends aren't unheard of in the legal system, especially when judges use legal precedence as guidance, and all juries aren't 'created equal'.
Not that I'm saying OP is necessarily right about UK divorce proceedings - I'm just rambling.
