My brother is a terrible housemate. what should i do?

Okay so my brother came to live with me and our mom after he got kicked out of his girlfriends house. He's been with us for a while now and has gotten on my nerves alot lately. He smokes in the house when he's suppose to smoke outside and it fills the entire lower level of the house. He hogs the bathroom (the ONLY BATHROOM) to the point where I and my mom have to pee in the sink in the basement. And he stays up all night with the tv volume high and basically show no consideration for the other people in the house. He's moving out in October and it seems as though he's gotten worse with these habits because he knows he's not gonna be here for long. Its really affecting me because my room is right next to the living room. Im always subject to.I'm constantly subjected to the smell of smoke and I can't sleep at night because of the noise and I'm starting to hate him. And the reason why i havent said anything before is because he never listens. Please someone tell me whether i should just wait until he moves or should I talk to him because if this persists the way it is there's going to be a problem.

    If he's going to be living with other people, I'd talk to him. If not, wait it out and let it go. Living with people incites a whole new level of temporary hatred.

    If you're really pissed off at him one day here's what you could do: take his ash tray and dump it on his pillow. That would create a very clear message to him about his smoking. There could be some blow back for doing that though..

    Why would your mom let him get away with that?
    She should flat chat tell him to stop making life miserable in HER house, unless it doesn't bother her. If that is the case, remember it IS her house and perhaps you need to find another place to live, right?

        That being said, the two of you live in terror of this person, yet you can't figure a way to rid yourselves of him? That's really pretty damn pitiful.

          I'm a senior in highschool and trust me if i would leave if I could but Ohio dosent have any emancipation laws that would allow me to do so.
          And I yes I agree it's pitiful, that's why I came here to ask for advise on how to deal with the issue WITHOUT there being a huge incident to where the police might be called.

    Of course talk to him. Politely at first, sternly the second time. The third time, personally for me, it would be a toss up between taking away the TV cable and his stash, or kicking him out regardless of how many days are left. Sounds extreme and barbaric, but if my sleep gets ruined, I don't function right the entire day. And I've never let anyone smoke in my car/place either.

    In companies, where employees give in their 2 weeks notice but start slacking around because of it, they get fired. I know he is family, but that should be all the more reason for you to be honest with him. I have a younger brother and if he was living with me and acting like an unreasonable tool, I'd make him sleep outside for a day. (as for the late night TV, there could be a peaceful solution if your TV has an audio port so he can plug in headphones)

      Thanks for the advice! I'm definitely gonna try to talk to him but as for kicking him our I have no choice in that. That would be my mom's call and I doubt she'll kick her son out of the house.
