Lawer issues

OK so I have questions I need answered about a month ago I was hit by a car and went to see doctors many of times for an injury and being out of work and i had not qualify for FMLA. And I been living with my mother taking care of me and this whole situation going through lawer. Anyways my girlfriend is 40 miles away about to give birth to my first child in two months ans I have no money at all. I now can return to work but I'm getting work up where she lives and move in with her ap I can take care of the baby. My mothers incidence is paying the bills for me living with her. Does me moving and getting a job up there instead of going back to my old job effect this case as far as the bills with her insurance or me getting a settlement claim at all?

    Unless you had less than 6 months on the job, FMLA isnt about qualifying. If you're sick for a long period of time and can't work, you take it. It's not up to an employer or doctor. It's unpaid leave and the government protects your job.

    Anything else I don't know, but as an employer in the past, we had no say in family medical leave of absence.

    Fmla won't effect a lawsuit. You're on FMLA leave when you say you are.

      Thats poor advice, an employer in the private sector can absolutely force you to take leave under FMLA. In the Federal Government that is a different story. And yes, there is qualifying time you have to work to be covered under the law, I believe it is 1250 hours.

      OP, please seek out your HR representative about your rights under FMLA, dont seek advice here. And definitely talk to an injury lawyer about the accident you were in.
