Is this rape...?

Man and a woman, both pretty drunk and feeling a bit loose. The guy makes lots of sexual advances and the woman - although somewhat unsure - goes along with it. He appears to put on a condom and they proceed to have sex.
During, she sees something strange on the floor and realises it's the condom... the one he was supposed to be wearing.

She's momentarily confused (being intoxicated doesn't help) and before she realises, he's finished.

She doesn't mention it, and he leaves.

Was she raped?

    I'm unclear, from this story whether you mean he intentionally faked putting the condom on, or somehow fumbled it being drunk. I think a good case could be made that the former is rape (or some similar crime), but if it was an accident, then no.

    I don't understand how any rational thinking person could consider this rape. If I tell a girl that I am going to marry her if she has sex with, does it become rape if I don't? If I stiff a hooker that was too stupid to collect in advance, did I rape her?

    A guy lying to a girl to get in her pants isn't rape any more than a girl lying to get in his wallet is stealing.

    Does not meet the legal burden of rape. Whether or not protection is used isn't a factor. You might have something if she only agreed if protection was used, but I still don't think it would be classified as rape. Way too many of you let your emotions guide you in matters where emotion has no tangible place in the argument.

              That aside, the op does say "the condom... the one he was supposed to be wearing".
              You say I didn't write that, so obviously you can't see it, but it's there.
              Hopefully that was the source of the confusion and it's now cleared up.

              The point of this was to give the facts of the scenario. The rest is open to interpretation.
              From the facts, I think it's clear that she only consented to sex with the understanding a condom was being used.

              But even that's open to debate - this is the whole point. Someone could argue that she DID consent to unprotected sex also, basing that on their interpretation of the facts as given.

              If it was an entirely clear-cut scenario, there would be no point asking the question.
              The idea is to interpret the situation based on the bare-bones facts.

              BUT, if you would like to suggest what I should have included, then go for it. Please, rewrite the op or just write the sentence/s that you feel is missing.
