I would go with no, although I would also say I wouldn't really hold pity for them. What Neuro said is also true, we don't know how many people that were put in prison for a crime they didn't commit so it's best not to take the chances.
Also, if we justify it happening then we're justifying rape, as in we're supporting a rapist, in jail or not.
