Not rape unless she's so drunk she's incapable of giving consent, but it's certainly cheating and taking unfair advantage
Pretty sure its rape if you sexually take advantage of some one thats impaired but I'm not a lawyer. Either way its a shitty thing to do.
I'm fairly sure that pretty much everywhere it's an issue of CONSENT: if the woman is asleep, unconscious, alcohol of drug affected to the extent that she can't give consent, then it is rape
