I think whatever you choose to do, you should seriously, seriously consider waiting at least until the divorce is absolutely final, and why not a few months after that.
We've had an ugly divorce in our family where both parties ended up using their childrens' and there siblings' feelings and testimony in court. It really ripped apart our family and really hurt the children; the divorce is still not official after 5 years and the father was given the worst part of the deal, financially speaking.
So just to be on the safe side, lawfully, financially and emotionally, I'd advice against doing anything of the kind. At lest WAIT until it's final.
