Is it normal to believe common sense should apply to laws?

Is it normal to think common sense should apply to laws? People sue for really stupid shit and its ridiculous. Some of them have won and this is not a very good message. I think common sense should apply to laws in all instances. If you break into someone else house and trip and break your leg illegally coming into there yard shouldn't you be arrested? Not the man who who is trying to steal your shit and broke his leg? I mean that's just karma right there. You were stealing and you tripped and broke your leg. Well you deserve a broken leg since your being an idiot and stealing.

  • That is the thing that amazes me about the Tort laws in some countries.

    The ability to simply brush aside personal responsibility and simply blame others for something of their own fault.

    Examples that make me cringe is people suing fast food restaurants for making them obese. There is so much information available out that warns people to control their consumption of such foods.

    Or another case I heard where a city authority was being sued because a child was hurt when she decided to let go of the swing in mid air and being thrown off the swing. Now the city authorities have decided to chain up all the swings and close off alot of the playgrounds in their area due to the fear of being sued again.

  • Every day there seem to be more and more ridiculous, unenforceable laws in the US. How can a law prohibiting nudity in one's own home be enforced without someone having to break another law (peeping). The United States has more incarcerated citizens than any other country on earth and the largest percentage of it's citizens, as well. But the ones that deserve it the most, the politicians and bankers, are free and making money from the unincarcerated citizens and the incarcerated ones as well (who do you think owns the private prisons?).
    That a woman could collect millions of dollars because SHE put a hot (who'd want to buy a lukewarm cup of coffee?) between HER legs while driving, is so far beyond my understanding that I have lost all respect for the US legal system.
    I know for a fact that Americans are not welcome employees internationally, as we are too litigious, and this even applies to many US companies overseas.
    The US legal system is as broken as our political system and unfortunately, there is little we, as citizens, can do about it.
    I see little hope for change beyond a complete collapse of the system, which is unlikely, because those in power will profit from even that, as they did from the American made world wide financial disaster of 2008.
    Boys and girls, ladies and gentlemen; we the people, are just fucked, at this point!

  • Criminal laws too. That's why I think mandatory minimum sentences are such a terrible idea. They prevent the judge from applying common sense.

  • It would be great if common sense could be applied to everything but that's not often the case unfortunately. It should be renamed 'unusual sense' since people hardly ever freaking use it.

  • "Common sense" is so subjective though. For the law to be resistant to corruption and tyranny every part of it needs to be codified, or else some random judge could start handing out whatever sentences he wanted because he believed it was "common sense", and no-one could stop him because his powers would be unchecked.

    That doesn't mean I don't think there are parts of the law that are out-dated or need to be made differently flexible, though.

    • Common sense is stuff we should already know. If someone breaks into a yard they should not be in they might get hurt on entering.

      For the following reasons. 1.dogs 2.since everything is closed you have to dig, climb or break in(meaning you run a higher chance of injury where as this would probably would never happen if they LET you in).

      If you eat fat food with 1000s of more calories than is recommended to eat in one setting you might get fat! Now if this complain is children who are required to be fed by parents well its bad parenting! and those parents need to feed the children proper food.

      Giving a child cookies and candy once in awhile is fine. Having a child who is 3 and over 200 pounds is not healthy! My cousin is 10 and he only weighs 80 and is thin.

        • I never said anything about judges. If you have something against the judge that is your own personal issues. That is not what this post is about.

          I am saying that you should not be able to sue someone since you got hurt because you chose to break another law. If you break the law any misfortune that befalls because of it is your own damn fault. We should not be saying "Its ok to break the law if you get injured doing so".

          What kind of idiocy is this? Have you ever heard of whats called "Due process"? If you can break the law this way than due process is not important either. That means cops/police can break into a house as long as they find drugs in that person house.

          Does it work that way? NO! So the same should apply here. Why does being a citizen make you above the laws and above the police? It shouldn't! We should all be held to the same standards.

          None of us are above the laws. If police follow this process why don't civilians have to? Do you really want to get rid of "Due process". Also this apply to everything. There is protocol which needs to be followed in all these cases. You think people should just pick and choose which laws are valid? That we should attack the victim not the perpetrator. You don't believe people have a right to be safe? Would you like if someone broke into your house and you paid them for it?

  • Laws are there for a reason, I don't think they are lacking common sense, but do require altering. Common Sense should be on people themselves. As for the broken leg, that depends how it happens. If the owner of the property was to (assault) by self defense, resulting in severe injury. They must be accountable for that action. As self defense is to immobile the perpetrator without physical assault.

  • You beautiful soul you :D I find myself often stuck at a red light when there is no one coming in either directions. I feel so repressed by "the man" and just want to stop, look both directions, see one coming, then go. It is so freaking pointless to sit there like a buffoon, waiting for the light to turn green when NO ONE is coming.

    Here I think a common sense law should be enacted. I can use my damn brain to realize no one is around me and there is no possibility of me getting hit.

    Sorry about the rant, but pointless red lights really grind my gears.

      • The stupid light by my house I am sure is on a dang timer. I have taken up the common sense rule at night. Stop, look both ways, see no one coming, and continue driving.

        It makes little sense to wait at a light for what feels like ages (probably only a few minutes haha) with no one around...I am probably over reacting, but still :P nice post.
