Well, yes, they CAN and do in many ways. Once they become an "employer" they are subject to certain employment laws. Religious organizations have some special exceptions that allow them to discriminate based on religious affiliation *sometimes* where other employers couldn't, but they still have to abide by the other employment laws that apply.
