  • This is a common misconception. Police don't have to read you your rights until you're officially in a custodial interrogation. From what you describe, you were just being detained, you weren't actually 'under arrest' or 'in custody' by legal definition. They can ask you questions at this point. You don't have to answer those questions. If you do answer those questions, it's admissible in court.

    Search warrants are granted by Judges, and require probable cause. He doesn't need a 'search warrant' if you give him permission to look. He also has the right to look if he sees anything illegal in plain view. He CAN look if he has probable cause, without your permission. You should deny him permission to look, then possibly anything he finds may not be admissible, no guarantee though, but it's best to deny regardless.
