Depending on what country you live on, that could be classed as child abuse and whether you testify against him or not, the law could still lock him up.
If you don't want him to do it anymore, then you either tell the local authorities/child protection or you change your behaviour so he would not have to spank you. If you like the spanking and don't want to get it from him, then there are places to go where they will do it to you (or you to them, whichever you prefer.)
