  • Local laws in individual cities and states can vary. But according to federal law and the US Dept of labor, in the United States, tip pooling , meaning sharing the tip with other persons, is completely legal. Cash or credit makes no difference legally.

    The persons included in the pool must be involved in serving the customer, such as a bus boy bringing the food to the table or clearing plates. Even a hostess seating the guest can be included. Basically anyone working Front of house can be included in the pool.
