The persons included in the pool must be involved in serving the customer, such as a bus boy bringing the food to the table or clearing plates. Even a hostess seating the guest can be included. Basically anyone working Front of house can be included in the pool.
I look up the law in my state and according to the state of California, either way, the server is legally entitled to 100% of the tip they receive but with the caveat of the possibility of sharing it with other service members.

When you leave a tip by credit card it legally must go to the server.

I only leave cash. Many restaurants don't follow the law.
