  • Well you certainly have rights in this situation too, but when a man has painful breast enlargement and lactation its a much bigger problem than it is with women, its also more rare. The lawyer knows he can make more money off of cases where it has happened to men, because it is more unusual and more unnatural, so its easier to prove harm and there are more "damages" that can be awarded in settlement. You can try and sue too, but if you win you will not be awarded as much money as you would be if you were a man.

    A good analog is testosterone supplementation. The side effects such as aggression and unwanted hair growth can be a problem for men, but if it were to happen to a woman, it would be considered more of an issue, so lawyers would rather sue for cases involving a woman.
