Nope, it's illegal because it's an easy revenue generator. If authorities wanted to stop it they could easily prevent starting a car if alcohol was consumed.
The fact is the "recovery" industry has good lobbyists and the states make an easy buck with fines, dui panels, occupational licensing, sr22's, blow and goes.
No one stops drunks from driving. They just shove their fists in the wallet of anyone who gets a dui.
