The problem is that marriage is supposed to be a legally binding contract and same sex marriage is not recognised under the law...which means there are no protected rights as a spouse: no joint tax returns, no financial protection in the event of a "divorce," no ability to make medical decisions regarding the spouse...or even access to medical records. As a non family member you wouldn't even be allowed to VISIT your spouse in the hospital if he/she were in a critical accident...
...Not to mention many other rights that aren't recognised when the marriage isn't considered legally binding...THAT is the problem.

But they can, anyone can hire a marriage celebrant, have a ceromony and fill out the forms saying they have a legal partnership. So whats the problem?
