Have you ever seen a citizens arrest

Just today I saw this old woman come up to me and said I was being put into citizens arrest. I'm white but I'm also aware of how white a citizens arrest is.

She was complaining that I was riding a motorized standup scooter (goes 15mph max) on the sidewalk and that's illegal. It is but the cops dont care because it's more safe for us to be on the sidewalks. CA has really shitty drivers that use and crash into bike lanes.

So she just stood there saying I'm under civilian arrest. So this bouncer goes on to see what's happening because we were on his corner, asks what's going on. Old lady responds. He says "that's the whitest shit ever" at that point I just walk away because a walking 21 yo is way faster than a in pursuit grandma trying to fumble with her phone.

    I don't imagine a citizen arrest has any legal backing. Not even most security guards have the authority to arrest people. I had a friend in security and asked about what a guard can do and he said, "They have the same rights as a citizen" meaning they can call ACTUAL law enforcement but that is about it.

      Yea back when I worked security they really drive that shit in. You are here to look pretty and help people. Keep notes and that's it. If something goes down do not strike call the cops etc etc.

    • I just read a little about it and it's basically a gray area in the law. While technically it isn't legal in most places, it's unlikely that you will be prosecuted for apprehending say, a school shooter, or a purse snatcher.

    My neighbor use to steal cars and break into barns and take everyones shit and he was caught by this old country boy on his farm and the guy beat his ass and ziptied him in a hogtied position. It was on the news and his police report is public.

    I'm not a lawyer, but I think this lady was absolutely and utterly full of shit. For one, I doubt that riding a motorized bike (that only goes 15 mph) on a sidewalk would actually be an offense that would result in an arrest.

    It could likely result in a ticket, but it probably would not be an arrest. That most likely would be simply a violation, which if a cop noticed you doing it, could detain you to give you a ticket. But I think that would simply be a violation, which wouldn't even be an arrestable offense anyways.

    Also, citizen's arrest generally applies to felonies and breach of the peace (e.g. someone committing an assualt or something of the sort) from what I've heard. For instance, if you (or a hypothetical person) were to assault or rob someone and were stopped in the act by bystanders, then the citizen's arrest would be valid. The other common scenario that's a citizen's arrest (though often not thought of as such) is when security guards detain a shoplifter before the police arrive.

    These sorts of citizen's arrest/good Samaritan laws wouldn't come into play for some petty thing like riding a bike on the sidewalk though, not in the US at least. The fundamental purpose of these laws is to make it legally possible for bystanders to intervene if someone is actually in danger or for shopkeepers to have the right to protect their property from thievery, not to give citizen's the power to hassle people as this lady was doing.

    • By motorized bike I mean scooters. Like it can theoretically go 15mph but for me it can pull a steady 10mph on a flat surface. Going uphill makes me go only 6mph at most. There are like a 1000 of these scooters about for public use all you need is a smartphone to interact with.

      Every time a car has almost hit me was when I was doing the "right" thing. I dont go 15mph on a crowded sidewalk.

    I think that's more of an American thing... Never heard of anyone doing a citizen's arrest in Europe. Although, I have seen crazy old people threatening to call the police over nothing.

    One time I was driving my mom to her phone company to pay bills and stuff. There were no free spaces to park, except one in front of a large driveway, where two cardboard boxes were placed. I kicked the boxes out of the way and parked there. 30 seconds later a crazy old lady comes and starts putting more boxes around my car, telling me this was her space and the police was on it's way as I was trespassing.

    My mom asked what was going on and started apologizing for some reason. I told her to get in the car, kicked the boxes out of the way again and drove home. No police came, even tho she said she had my license plates written down...

          • The twist to the story is I was taking something back stolen from me. The kid went to his dad and said I stole it, then they found me down the street. Police took my side.
